1.ACCEPTANCE OF THESE TERMS
These Terms & Conditions ("Terms") govern your use of the Sturgess Customs website and your purchase of products and installation services from Sturgess Customs, 4262 Augusta Rd, Lexington, SC 29073. By using this website, requesting a quote, or hiring us to perform work, you agree to these Terms. If you do not agree, do not use the website or our services.
2.OUR SERVICES
Sturgess Customs provides vehicle customization products and installation services, including car audio, marine audio, motorcycle audio, driver-assistance and safety systems, remote start and security, lighting, and related 12-volt work. Descriptions on this website are general; the scope of any specific job is defined at consultation and in your written quote or invoice.
Safety-related products we install (backup cameras, parking sensors, blind-spot systems, dash cams) are driver-assistance tools only. They do not replace attentive driving, and we make no representation that any system will prevent an accident, theft, or loss.
3.QUOTES AND ESTIMATES
Quotes are free and are estimates based on the information available at the time. Final pricing may change if the vehicle’s condition, existing wiring, or requested scope differs from what was described — we will tell you before performing work beyond the quoted scope. Quotes are valid for a limited time (stated on the quote) and do not obligate you to book work.
4.SCHEDULING, VEHICLE DROP-OFF, AND PERSONAL PROPERTY
- Appointment times are estimates; complex builds can take longer than initially projected, and we will communicate schedule changes as early as possible.
- Please remove valuables and personal property from your vehicle before drop-off. We are not responsible for personal items left in the vehicle.
- Vehicles must be picked up within 24 hours of our notice that the work is complete. Notice may be given by phone, text, or email using the contact information you provide to us. Our shop space is limited and we are not able to store completed vehicles.
- Vehicles not collected within that 24-hour window may incur a storage fee of $100 per day for each day the vehicle remains on our property. Sturgess Customs may waive or reduce this fee at its discretion.
- We may drive your vehicle as reasonably necessary to test installed systems.
5.PAYMENT AND FINANCING
Payment is due upon completion of the work unless agreed otherwise in writing. Some builds require a deposit for special-order components; deposits on special-order parts are non-refundable once the order is placed.
Financing offered through Acima and Snap Finance is provided by those companies under their own terms and approval processes. Sturgess Customs is not the lender and is not a party to your financing agreement.
6.WARRANTIES
- Installation workmanship is warranted by Sturgess Customs. Specific terms (duration and coverage) are provided at the quote stage and on your invoice for your specific install.
- Components carry their manufacturers’ warranties, which pass through to you. We will assist with warranty claims on components we supplied and installed.
- Warranties do not cover damage from misuse, accident, water intrusion beyond a component’s rating, modification by others, or failure of pre-existing vehicle systems.
- EXCEPT AS EXPRESSLY STATED IN WRITING, ALL SERVICES AND PRODUCTS ARE PROVIDED WITHOUT OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.
7.LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STURGESS CUSTOMS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST TIME, LOST USE OF A VEHICLE OR VESSEL, OR LOST DATA ON MEDIA DEVICES) ARISING FROM OUR SERVICES OR THIS WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE WORK GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot be limited under South Carolina law, or your rights under applicable consumer-protection law.
8.WEBSITE CONTENT AND INTELLECTUAL PROPERTY
Website content — text, photos of our work, the Sturgess Customs name and logo — belongs to Sturgess Customs or its licensors and may not be copied or used commercially without permission. Manufacturer names and logos (Hertz, Audison, JBL, Kenwood, Stinger, and others) are trademarks of their respective owners and are used to identify products we install; their appearance does not imply sponsorship of this website. Website content is provided for general information and may contain errors; it is not a binding offer.
9.REVIEWS, PHOTOS, AND CUSTOMER SUBMISSIONS
If you give us a testimonial, review, or permission to photograph your vehicle, you grant Sturgess Customs a non-exclusive, royalty-free license to use that content (with your name or initials, as agreed) on our website, gallery, and social media. You can withdraw consent for future use at any time by contacting us, and we will remove the content from surfaces we control. Reviews posted on Google are governed by Google’s terms.
10.MOBILE MESSAGING TERMS
These terms apply to the Sturgess Customs text messaging program. By opting in, you agree to them.
Program. Sturgess Customs sends text messages about quotes, projects, appointments, vehicle status, and occasional shop news and offers to customers who have asked to receive them.
Consent. You opt in by ticking the SMS consent box on our quote form, by texting us first, or by telling our team you would like text updates. Consent is not a condition of any purchase. You can request a quote, book work, and buy from us without ever agreeing to text messages.
Cost. Message and data rates may apply. Sturgess Customs does not charge for the messages; your mobile carrier may, depending on your plan.
Frequency. Message frequency varies based on your project and your conversation with us.
Opting out. Reply STOP to any message to end all messages. We will send one confirmation and nothing further. Reply HELP for assistance, or contact the shop at 803-705-0341 or sturgesscustoms@gmail.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Eligibility. You must be at least 18 years old and the account holder or authorised user of the mobile number you provide.
Your information. Mobile opt-in data and consent are never sold or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for the full detail.
Changes. We may modify or end the messaging program at any time. Continuing to receive messages after a change means you accept the updated terms.
11.ACCEPTABLE USE OF THIS WEBSITE
You agree not to misuse the website: no scraping, no attempting to breach security, no submitting false quote requests, and no submitting content that is unlawful, infringing, or abusive. We may block access for misuse.
12.GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Any dispute arising from these Terms or our services will be brought in the state courts located in Lexington County, South Carolina, and you consent to the jurisdiction of those courts.
13.GENERAL
- Changes. We may update these Terms; the version posted at the time you use the site or book work applies. Material changes will be posted on this page.
- Severability. If any provision is held unenforceable, the remainder stays in effect.
- Entire agreement. These Terms, together with your written quote/invoice, are the entire agreement for the work described. If a signed written agreement conflicts with these Terms, the signed agreement controls.
